GO Photo & Web - Terms & Conditions

Photographic Coverage:
1. GO Photo & Web take every step possible to ensure the quality of our work, we cannot however guarantee the following:
  1. The quality of the professional film that we use.
  2. The quality of the professional film processing that we use.
  3. Any errors made by the processing lab, when processing your film.
  4. Any unforeseen camera or flash failure.
2. GO Photo & Web does not accept any responsibility for any circumstances outside of our control such as the weather, events running over time, physical changes to the location(s) cause by a third party that effect the look, that may effect the cost or quality of the final job.
3. GO Photo & Web will not take instruction on what to photograph/print ect… from any other party other than the primary contacts.
Privacy/Confidentiality/Copyright:
1. GO Photo & Web collect information for the sole purpose of communicating to you. Your information will be kept secure and will not be sold or sent to any other organization or individual.
2. All project information is confidential. GO Photo & Web will not show any information about your project to anyone other organization or individual accept the finished product which we reserve the right to include in our portfolio.
3. GO Photo & Web reserves the right to copyright media created by GO Photo & Web.
4. No photography may be used in any magazine publication except with prior consent from GO Photo & Web. In this case GO Photo & Web must be correctly credited.
5. All information and prices given to the client by GO Photo & Web is privileged information and may not be shared, copied or shown to any other party unless permission is received prior, by GO Photo & Web.
Fees & Charges:
1. GO Photo & Web reserves the right to charge extra fees for the following:
  1. Changes or modifications to the brief.
  2. Extra photographic coverage ordered on the day of the shoot.
  3. Extra support if not required due to errors caused by GO Photo & Web.
  4. Extra travel.
  5. Phone conversations except where providing support when GO Photo & Web is responsible.
2. GO Photo & Web invoices are to be paid in full within 14 days prior to the shoot date except where otherwise stated.
3. GO Photo & Web reserve the right all copyright of all material created by GO Photo & Web until full payment has been made.
4. Payments can be made by EFT, Cheque, money order, credit card or eftpos.
5. A 10% Goods and Services Tax is charged on all jobs except when the clients address is outside Australia.
6. GO Photo & Web reserves the right to change its fees and charges at any time without notification except when bound by a prior agreement.
Cancellation:
1. Cancellations must be submitted in writing and shall be effective only when received by the GO Photo & Web.
2. Cancellations may only be made no later than 2 weeks prior to the shoot date, otherwise the full payment is payable.
3. No deposits or payments are refunded.
Disputes and Limitation Of Damages:
1. In the event of a dispute, GO Photo & Web and the Client shall endeavor to seek an amicable and faithful agreement. If the parties fail to reach such agreement, the dispute shall be referred to an appropriate Victorian court and shall be governed solely by Victorian & Australian Federal law.
Acknowledgement
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND HAD AN OPPORTUNITY TO SEEK INDEPENDENT LEGAL ADVICE PRIOR TO AGREEING TO IT. IN CONSIDERATION OF GO PHOTO & WEB PTY LTD AGREEING TO PROVIDE THE SERVICES LISTED ABOVE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND GO PHOTO & WEB PTY LTD, WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATION BETWEEN YOU AND GO PHOTO & WEB PTY LTD RELATING TO THE SUBJECT OF THIS AGREEMENT.
